U.S. Data Privacy Policy

Last updated: October 1, 2020

Peak Performance Inc. (“Peak Performance”, “we”, “us”, or “our”) is committed to protecting your privacy.  Peak Performance is a workforce training company that provides industry experts, engaging curriculum and an innovative platform to deliver an individual, effective and enjoyable training experience. This privacy policy describes our practices regarding the personal information we collect from users for any of our services on our website or mobile application.

What data do we collect?

When you sign up for an account, you provide us your name, email address, password and employer to register with us. In addition, we collect information as part of your training profile such as selected training certification path(s). When you post content (text, images, photographs, videos, messages, comments or any other kind of content) within our site or services, the information contained in your posting will be stored and other users of our site/services will be able to see it if you post in an area made public, such as comments on our courses or blogs. Site administrators have the ability to see any content regardless of privacy settings selected.

When you place an order, we or our third-party payment processor will collect payment, shipping and billing information in order to process the transaction. We collect information about your purchases and returns. We do not process, record or maintain your credit card or bank account information. All credit card transactions are processed using secure encryption - the same level of encryption used by leading banks. Card information is transmitted, stored, and processed securely at gateways on a PCI-compliant network.

If you provide us feedback or contact us via email, we will collect your name and email address as well as any other content included in the email, in order to send you a reply.

We collect data about how many people visit our site, whether or not their IP address is associated with a business, what pages and products they browse, and what they buy. We also collect information on how visitors came to us (via an email, a Google search, a social post), how much time they spend on the site, how much of our videos are being watched, what parts of pages visitors are viewing, and when and where they leave the site. Once a visitor leaves our site, we're no longer tracking them. If you give us your email address to download a particular piece of content, we track how many other items you've downloaded and what kind of content you've browsed.

When you participate in one of our surveys, we may collect additional profile information.

How do we collect it?

When you use our Site or App some information is automatically collected. For example, your geographic location, information about the type of device you use and date/time stamps for your visit. For visits and site behavior, we use bits of tracking code that assign a "cookie" to a visitor and then monitor that cookie as long as it’s on our site. For emails, we use the information you choose to give us when you fill out a form. Our associates may also manually add your email to our database if they are keeping track of a conversation with you (such as fulfilling a quote request, pricing questions, service requests, etc). Our tracking code stays on our site and does not follow you around the web.

We do not buy "spam lists" of emails.

What do we do with it?

In general, personal information you submit to us is used either to respond to requests that you make, aid us in serving you better, or market our products and services. We collect this data to understand the following:

  • What content is valuable to our visitors and what content isn't very useful? What do our visitors want to see more of?

  • What channels do our visitors like to engage with us on? Do they prefer email, Facebook, LinkedIn, or something else?

  • Where are visitors encountering difficulty using the site? Where should we devote resources to improving the experience?

We provide access to your employer to view your training records, course progress, course completions and assessment results. Your course activity may also be included in group activity reports generated by your employer.

We may choose to create anonymous data records from personal information by excluding information (such as your name) that makes the data personally identifiable to you. We may use this anonymous data to analyze patterns so that we may enhance the content of our services and improve Site and App navigation. We reserve the right to use anonymous data for any purpose and disclose anonymous data to third parties at our sole discretion.

The data we collect helps us make smarter decisions about creating content that enriches your day and provides you the products and services that you desire. We believe that if we provide value, you'll choose to trust us with your business.

What we do not do with it:

We will never sell your data to a third party or attempt to trick you into buying anything or downloading something you don't want.

Third Party Websites

Our Site or App contains links to third party websites. When you click on a link to any other website or location, another entity may collect personal information or anonymous data from you. We have no control over, do not review and are not responsible for these outside websites or their content. We encourage you to read the privacy policies of every website and App you visit.

Other Disclosures

We will implement reasonable and appropriate security procedures consistent with prevailing industry standards to protect data from unauthorized access by physical and electronic intrusion. Unfortunately, no data transmission over the Internet or method of data storage can be guaranteed 100% secure. Therefore, while we strive to protect your Personal Information by following generally accepted industry standards, we cannot ensure or warrant the absolute security of any information you transmit to us or archive at this site.

Regardless of any choices you make regarding your personal information, Peak Performance may disclose personal information if it believes in good faith that such disclosure is necessary: (i) in connection with any legal investigation; (ii) to protect or defend the rights or property of Peak Performance or users of the services; and/or (iii) to investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy, or our Terms of Use.
